NOTICE CONCERNING POLICYHOLDER RIGHTS IN AN INSOLVENCY UNDER
THE MINNESOTA INSURANCE GUARANTY ASSOCIATION LAW

The financial strength of your insurer is one of the most important things for you to consider when determining from whom to purchase a property or liability insurance policy. It is your best assurance that you will receive the protection for which you purchased the policy. If your insurer becomes insolvent, you may have protection from the Minnesota Insurance Guaranty Association as described below but to the extent that your policy is not protected by the Minnesota Insurance Guaranty Association or if it exceeds the guaranty association’s limits, you will only have assets, if any, of the insolvent insurer to satisfy your claim.

Residents of Minnesota who purchase property and casualty or liability insurance from insurance companies licensed to do business in Minnesota are protected, SUBJECT TO LIMITS AND EXCLUSIONS, in the event the insurer becomes insolvent. This protection is provided by the MINNESOTA INSURANCE GUARANTY ASSOCIATION, 4640 West 77th Street, Suite 342, Edina, MN 55435.

The maximum amount that the Minnesota Insurance Guaranty Association will pay in regard to a claim under all policies issued by the same insurer is limited to $300,000. This limit does not apply to Workers’ Compensation insurance. Protection by the Guaranty Association is subject to other substantial limitations and exclusions. If your claim exceeds the guaranty association’s limits you may still recover a part or all of the amount from the proceeds from the liquidation of the insolvent insurer, if any exist. Funds to pay claims may not be immediately available. The guaranty association assesses insurers licensed to sell property & casualty or liability insurance in Minnesota after the insolvency occurs. Claims are paid from the assessment.

THE PROTECTION PROVIDED BY THE GUARANTY ASSOCIATION IS NOT A SUBSTITUTE FOR USING CARE IN SELECTING INSURANCE COMPANIES THAT ARE WELL MANAGED AND FINANCIALLY STABLE. IN SELECTING AN INSURANCE COMPANY OR POLICY, YOU SHOULD NOT RELY ON PROTECTION BY THE GUARANTY ASSOCIATION.

THIS NOTICE IS REQUIRED BY MINNESOTA STATE LAW TO ADVISE POLICYHOLDERS OF PROPERTY AND CASUALTY OR LIABILITY INSURANCE POLICIES OF THEIR RIGHTS IN THE EVENT THEIR INSURANCE CARRIER BECOMES INSOLVENT. THIS NOTICE IN NO WAY IMPLIES THAT THE COMPANY CURRENTLY HAS ANY TYPE OF FINANCIAL PROBLEMS. ALL PROPERTY AND CASUALTY OR LIABILITY INSURANCE POLICIES ARE REQUIRED TO PROVIDE THIS NOTICE.



UNINSURED AND UNDERINSURED MOTORISTS COVERAGE'S


Every owner of a motor vehicle registered or principally garaged in Minnesota is required to maintain Uninsured and Underinsured Motorists Coverage's at basic limits. Increased Limits of coverage are available (Both must be same limit and equal to or less than your Bodily Injury Limits).



FULL SAFETY GLASS COVERAGE


If your policy provides Comprehensive (Other Than Collision Damage) coverage on your auto with a deductible applying, as an option you may also purchase Full Coverage for repair or replacement of all damaged safety glass without regard to any deductible.


ACCIDENT PREVENTION COURSE DISCOUNT


This discount rewards those drivers age 55 or older completing a motor vehicle accident prevention course and who maintain satisfactory driving records. In order to verify eligibility and to enable the discount (10% applied to Liability, Personal Injury Protection, Collision, Other Than Collision [Comprehensive] and Uninsured/Underinsured Motorists), a Certificate of Course Completion, provided by the organization offering the course, must be submitted to us.



ANTI-THEFT PROTECTION DEVICE DISCOUNT


A discount of 5% applies to the Comprehensive (Other Than Collision) coverage premium for a vehicle if the vehicle is equipped with an anti-theft device. The device is provided by the manufacturer of the vehicle as original equipment, or is installed in the vehicle by the manufacturer of the vehicle or an authorized dealer of the manufacturer. It is self-activating upon removing the key from the ignition and upon locking the doors. The device must do one or more of the following when activated : 1. sound an alarm; 2. cause the vehicle horn to sound; 3. cause the vehicle lights to flash; 4. cause the vehicle to be rendered inoperable. To allow the discount, a Certificate, provided by the manufacturer and/or installer, must be submitted to us.



GOOD STUDENT CREDIT


A Good Student Credit is available for those eligible youthful drivers meeting the Good Student criteria. To allow the Credit, verification of the grades (Transcript) must be submitted to us



DISHONORED PAYMENT OF INITIAL PREMIUM


If your initial premium payment is dishonored by the bank on which payment is drawn, NO contract of insurance has existed.



CUSTOMIZED, MODIFIED AND SPECIALLY EQUIPPED AUTOS


If you have requested coverage on an auto that has been customized, modified, structurally altered or is specially equipped (such as but not limited to sound equipment, GPS, phone, fax machine, snow/gravel blade, topper, camper, tool boxes, rims, tires, wheels, etc.) or with custom paint or painted murals, please provide color photos, interior and/or exterior, showing the customization or modifications. Coverage may be available at an additional charge for such customization or modification.



INCOME LOSS OVER AGE 65 - ELECTION TO EXCLUDE INCOME LOSS


Minnesota Stautes require that PIP coverage must include Income Loss Benefits. "Income Loss" provides loss of earnings income due to injuries sustained in an auto accident. This benefit is obviously very important to those people who are working and not yet retired. But Minnesota Statutes also allow a person age 65 or older or a person age 60 or older who has retired and is receiving a pension to to elect not to have the coverage for "Income Loss" in exchange for a reduced premium. An election not to have that coverage remains in effect until that election is revoked, at which time "Income Loss" may be restored to the policy for subsequent accidents.

NOTICE OF INSURANCE INFORMATION PRACTICES

In order to evaluate your application for insurance, we occasionally need certain additional information. Most of the information you have already provided us. The purpose of this notice is to inform you of your privacy rights concerning information we gather from other sources and our compliance with privacy laws

On occasion, we will need additional information or will want to verify particular information.  Therefore, we gather additional information from other sources, such as motor vehicle records, consumer reports and claim reports.



Motor Vehicle Records

When you apply for, renew, change or reinstate your auto insurance, we order a copy of your motor vehicle record from your state’s motor vehicle department. Your motor vehicle record contains information about accidents and violations of state traffic laws.



Consumer Reports

When you apply for, renew, change or reinstate your auto insurance, we may order a consumer report from an outside consumer reporting agency. The consumer report contains information about credit history. If we take adverse action on your policy because of information contained in your consumer report, we will provide a written notice to you with the name and address of the consumer reporting agency. You have the right to request a copy of your consumer report and correct any information contained in the report by contacting the consumer reporting agency.



Claim Reports

When you apply for, renew, change or reinstate your auto insurance, we may order a claim report from an outside insurance-support organization. This organization maintains a database which includes information about insurance claims you have had in the past. We will also submit information about your claims with us to this organization.



Disclosure Of Personal Information

We usually do not disclose information about you to others without your consent. However, in some circumstances we may disclose information to others without your prior authorization. The most common disclosures are to the following persons:


  • Other insurance companies, agents, or consumer reporting agencies in connection with any application, policy or claim involving you.

  • Persons who need information to perform a professional, business or insurance function for us, provided they agree not to disclose the information further without your written authorization.

  • Persons or organizations, including law enforcement agencies, who need information to determine eligibility for insurance benefits or payments; to detect or prevent criminal activity, fraud, misrepresentations; or material nondisclosure in connection with an insurance transaction.

  • Medical professionals to verify your insurance coverage or to verify the individuals treated by the medical professional.

  • Governmental authorities to determine your eligibility for government health benefits.

  • Certificate holders or policyholders to provide information about the status of an insurance transaction.

  • Lien holders, mortgages, assignees, lesser, or other persons having a legal or beneficial interest in your policy, provided the information disclosed is limited to that which is reasonably necessary to permit such person to protect its interests in the policy.

  • Adjusters, appraisers, or investigators for the purpose of investigating or settling claims.

  • Authorized personnel of the Division of Motor Vehicles upon request.



How You Can Find Out What Information We Have About You


You have a right upon written request to us, to obtain a copy of any recorded personal information we have in our files. Your request must contain your full name, address, and policy number. We will, within 30 business days from the date we receive your request, send you a copy of the information we have. We will also tell you the identity, if known, of those persons to whom we have disclosed personal information within the prior two years. If the identities of these persons are not known, we will tell you the names of those persons to whom we normally disclose such information. There are some types of information, however, to which we are not required to give to you access, such as information collected when we evaluate a claim or when the possibility of a lawsuit exists.

You have right to make a written request of us to correct, amend, or delete any recorded personal information we have on you. We will, within 30 business days from the date we receive your request, either correct, amend or delete the disputed portion of the information or we will notify you of our refusal to do so, the reasons for refusal, and your right to file a supplementary statement disagreeing with our refusal. If we refuse to correct, amend, or delete personal information, you have the right to file a concise statement setting forth what you think is the correct, relevant, or fair information and a concise statement of the reasons you disagree with our refusal to correct, amend, or delete the information. If you file either statement, we will file the statement with the disputed information. In this case, anyone reviewing the disputed information will also receive your statement. We will also furnish your statement to any persons or insurance support organizations to whom we previously provided the personal information in dispute.

If we agree to correct, amend, or delete the recorded personal information about you, we will notify you in writing. We will furnish the correction, amendment, or deletion to any person you specifically designate who may have, within the preceding two years, received the information from us. The correction, amendment, or deletion, will also be furnished to any insurance support organization which systematically receives such information and still maintains it about you and to any insurance support organization that furnished us with the information that has been corrected, amended, or deleted.

PERSONAL INJURY PROTECTION (PIP) ADDITIONAL OPTIONS

Personal Injury Protection (PIP), as required by Minnesota No-Fault Automobile Insurance Act, is the program or package of no-fault benefits which includes benefits for medical expenses, income loss, essential services expenses, funeral expenses and survivors' loss. By law, the named insured may select any or all of the following PIP options at renewal time or at any time during the policy period provided that you notify us of your new election. An election will only apply to accidents occurring after you notify us of the election. Each option involves a premium charge or premium reduction.

PIP Deductibles

A $100 deductible applicable to Medical Expense Benefits and/or a $200 deductible applicable to Income Loss Benefits are/is available for a reduced premium. Higher deductibles are NOT permitted by statutes.

The STACKING of Personal Injury Protection (PIP) coverage's is EXCLUDED. However, policyholders MAY ELECT to STACK their PIP benefits for a slight increase in premium. STACKING is the adding together of the same PIP coverage's from two or more insured vehicles to arrive at an aggregate total coverage available. Unless, a policyholder makes a SPECIFIC ELECTION to have two or more auto PIP limits added together, the limit of liability for Personal Injury Protection (PIP) coverage's may NOT be added together to determine the limit of coverage available. STACKING is limited to ONLY the PIP BASIC LIMITS of $20,000 / $20,000.
